2. Eligibility and Intended Use
Products are designed for trained adults in professional, industrial, or commercial settings. Users must be at least 18 years old and possess necessary knowledge and experience to safely operate pneumatic tools. Consumer, household, or hobbyist use is not permitted unless explicitly stated.
3. Orders and Acceptance
Lucid Aero reserves the right to refuse, cancel, or limit orders for suspected fraud, export restrictions, pricing errors, or inventory issues. Order confirmation does not constitute acceptance until the product has shipped.
4. Pricing, Taxes, and Billing Errors
Prices are in U.S. Dollars unless stated otherwise. Taxes, duties, customs fees, and shipping are not included unless explicitly noted. Lucid Aero may correct any pricing or billing errors, even after submission, including canceling orders and issuing refunds.
5. Payments and Authorization
Payments process through third-party processors. Submitting payment information authorizes Lucid Aero to charge all order-related amounts. Users must be authorized to use their provided payment method.
6. Shipping and Delivery
Shipping dates are estimates only and not guaranteed. Risk of loss and title pass to the buyer upon delivery to the carrier per applicable law. Users are responsible for accurate shipping information and compliance with import and customs regulations.
7. Returns and Refunds
Returns and refunds are governed by Lucid Aero's separate Return and Refund Policy. The company does not accept returns of used, damaged, or modified tools unless required by law.
8. Export Controls and Sanctions Compliance
Products may be subject to U.S. and international export control laws. Users agree not to export or use products in violation of export laws or trade sanctions. Users confirm they are not located in prohibited countries or on restricted party lists.
9. Product Use, Safety, and Assumption of Risk
Pneumatic tools carry inherent risks of serious injury or death. Users must read safety instructions, use appropriate protective equipment, and maintain proper air supply and pressure. Users assume all risks associated with product operation.
10. Warranties and Disclaimers
Products are provided "as is" and "as available" without warranties unless expressly stated in written documentation. Lucid Aero disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some state limitations may not apply.
11. Limitation of Liability
Lucid Aero is not liable for indirect, incidental, special, consequential, or punitive damages. Lucid Aero's total liability shall not exceed the amount paid by you for the product giving rise to the claim.
12. Indemnification
Users agree to indemnify and hold harmless Lucid Aero from claims arising from product misuse, Terms violations, or legal violations.
13. Chargebacks and Dispute Resolution
Users must contact Lucid Aero directly before initiating chargebacks or payment disputes. Unauthorized chargebacks may result in account restrictions or refusal of future orders.
14. Digital Content and Documentation
Manuals, videos, and documentation are informational only and may be updated without notice.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Washington and the United States, without regard to conflict-of-law principles. Legal actions arising from these Terms must be brought in the state or federal courts located in King County, Washington, and users consent to the jurisdiction of those courts.
16. Changes to These Terms
Lucid Aero may modify Terms anytime. Updated versions appear on the Site with new effective dates. Continued use constitutes acceptance.
17. Severability
If any provision is invalid, remaining provisions continue in full force.
18. Entire Agreement
These Terms and referenced policies constitute the complete agreement regarding Site use and product purchases.
